The party who is to be away during the resale transaction must get a solicitor to prepare the Power of Attorney. After the Power of Attorney is duly signed by the absent party, the solicitor will register the Power of Attorney at the High Court Registry. Two certified true copies of the Power of Attorney by the solicitor must be produced at the resale first appointment. Notwithstanding the Power of Attorney, the Donor (the absent party) must personally sign the Application Form, Statutory Declarations, and/or any undertakings. For Statutory Declarations, the Donor must execute them in the presence of a Commissioner of Oaths or Notary Public.
