SINGAPORE: A record 1,500 people turned up at a seminar to find out how to stay on the right side of the law when the amended copyright legislation comes into force.

With the amendments coming into effect on 1 January next year, offenders face a fine of up to $20,000 and six months' jail for copyright infringements.

The Software Asset Management (SAM) seminar on Thursday was conducted by the Intellectual Property Office of Singapore (IPOS) and the Business Software Alliance (BSA).

Thursday's attendance was more than double the number at the last seminar in September.

Jimmy Wu, a partner at Deloitte &amp; Touche, said: "Singapore has one of the strongest and clearer regulation in the Asia Pacific. In relation to Software Asset Management practices, however, Singapore corporations in general are still very primitive because Singapore CEOs and organisations just haven't been practising Software Asset Management in the past."

Business Software Alliance's Jeffrey Hardee said: "When people become aware of the legal risk associated with under-licensing, they will perhaps be more inclined to look at their policies and to adopt an effective Software Asset Management system."

There are also licensing clinics conducted by major software companies for businesses, to better understand software licensing agreements.

The new laws are also applicable to individual end users.

<FONT color=#ff0000>Liew Woon Yin, director-general of Intellectual Property Office of Singapore, said: "Downloading even one copy is an act of infringement, although it is not a criminal offence. We're not targeting the homeowners, or those who download one or two copies for personal consumption. We're talking about consumers who download thousands of copies and share the copies with their friends. It does not matter that in sharing or in distributing the copies, whether they actually made any money out of it."

In collaboration with 10 software companies, IPOS has initiated a Software Licensing Programme.

From now until the end of the year, they'll be offering up to 40 percent discount on their software to businesses, especially the small and medium enterprises (SMEs), to help them prepare for the new copyright legislation. </P>

<P>SINGAPORE: Singapore will next year introduce jail terms and stiff fines for people who break software and Internet copyright laws, the government said Tuesday.

People found to be illegally using software or downloading off the Internet will face a maximum six months in jail and a fine of S$20,000 (US$11,900) for their first offence, according to amendments to the Copyright Act introduced into parliament.

Repeat offenders face three years in jail and a fine of S$50,000.

The laws specifically refer to people who break the law "to obtain a commercial advantage" or infringe significantly, <FONT color=#ff0000>meaning individuals who download a limited number of songs or movies off the Internet for personal use may be exempt.</FONT>

A spokeswoman for the Intellectual Property Office of Singapore said the courts would be left to interpret the definition of "significant".

<FONT color=#ff0000>Although the spokeswoman stressed the courts would set the precedent, she said people who downloaded one song or movie were unlikely to be prosecuted but "1,000 could be pushing it".</FONT>

She said parliament was likely to pass the amendents by the middle of the next month, with the new laws due to take effect from January 1 next year.

The tougher laws are part of Singapore's commitments to its free trade agreement signed with the United States that came into effect this year.

Previously people who breached software and Internet copyright laws in Singapore were only subject to civil action.

Tougher penalties for the illegal manufacturing, sale and distribution of software remain unaffacted by the new laws. - AFP
